Foreclosure Services

 


We do not consider this list of services to be exhaustive but, rather, typical of the actions Carlisle, McNellie, Rini, Kramer & Ulrich Co., L.P.A. must take to complete an uncontested or mildly contested foreclosure case:

• Obtaining Preliminary Judicial Report; preparation and filing of Complaint for Money and Foreclosure. We are accustomed to the various differences in loan documentation and are comfortable with cases involving due on sale violations, modification agreements, multiple properties and the like

• Memo to your office advising of the filing of the Complaint, enclosing an Affidavit of Status of Account, to be executed, notarized and returned by your staff, along with a copy of the Complaint and, upon request, a copy of the Preliminary Judicial Report

• Following the Court Docket regularly; obtaining proper service of process on the defendants, including preparation of Service by Publication documentation when necessary

• Memos to your office upon the occurrence of significant steps in the foreclosure process and monthly status memos on all of your cases. The monthly report is computer generated and can be tailored to your particular needs within certain limitations

• Preparation and filing of Motion for Default Judgment, when necessary; attendance at Default Hearings when required; obtaining Final Judicial Reports

• Preparation and filing of Motion for Summary Judgment when responsive pleading sets up a general denial defense; attendance at hearing on Motion when required

• Preparation and filing of Judgment Entry for Money and Foreclosure; ordering Sheriff's Sale; obtaining Sheriff's Sale advertisement and notification of your office; and, attendance at sale for purposes of bidding on your behalf

• Preparation and filing of Confirmation and Distribution Entry (other than in Cuyahoga County as this is done administratively by the Court); receipt and recording of Sheriff's Deed or receipt and transmittal of proceeds of sale

• Attendance at Pre-Trial; preparation of Pretrial Statement when required; negotiate with opposing counsel

• Handling reinstatement of loan upon approval by your office; transmittal of funds and dismissal of case

• Notification to you (or designated officer) of any unusual claim, counterclaim or defense
